Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Super Games, Inc., a Delaware corporation trading as “Molly's Match” (“Super Games”, “we”, “us” or “our”). They govern your download and use of the Molly's Match: Win Cash! mobile application, the mollysmatch.com website, and related content and services (together, the “Game”). By downloading, accessing or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.

IMPORTANT: SECTION 16 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT AFFECTS HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION 16.

The important points at a glance

You must be 18 or over (and the age of majority where you live), a legal resident of an Eligible State listed in the Official Rules, and physically located in an Eligible State to participate; you may hold one account only. The Game is free to play, and every prize mechanic can be entered for free, including by mail. Optional in-app purchases are for digital content only; every entry has an equal chance of winning, and the odds of the $10,000, $100,000 and $1,000,000 weekly random number match prizes are fixed per entrant per week and cannot be increased by any purchase. Prize mechanics are governed by our Sweepstakes Official Rules at mollysmatch.com/rules, which form part of these Terms. Prize Account balances are redeemable once they reach your Redemption Threshold (shown in-Game; always between US$0.25 and US$100) and are paid through our designated payment processors. You can set spend limits in Settings and self-exclude at any time.

1. About us and how to contact us

The Game is operated by Super Games, Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, United States. Contact us at support@super.gs or through in-Game support. If we need to contact you, we will do so in-Game or using the email address associated with your account, and notice is effective when sent.

2. Other terms that apply to you

In short: The Official Rules govern the prize mechanics. The Privacy Policy explains our use of your data. Both apply alongside these Terms.

The following are incorporated into these Terms by reference: (a) the Molly's Match Sweepstakes Official Rules (the “Official Rules”), available at mollysmatch.com/rules, which govern all Instant Win, Weekly Guaranteed Prize Drawing and Weekly Random Number Match prize mechanics, including eligibility, entry, free mail-in entry, odds, winner selection, verification, taxes, forfeiture and payment; and (b) our Privacy Policy, available at mollysmatch.com/privacy. If there is any inconsistency between these Terms and the Official Rules in relation to any prize mechanic, entry, prize or Prize Account balance, the Official Rules control.

3. Who can play, and your account

In short: 18+, Eligible States only, one account per person, accurate information, and we verify location and identity.

The Game is intended only for legal residents of the Eligible States identified in the Official Rules who are 18 years of age or older (and have reached the age of majority in their state) and who are physically located in an Eligible State while participating. Accounts of ineligible persons will be closed, entries invalidated, and no prize awarded. You may create and hold one (1) account only; creating or using multiple accounts, or sharing an account, is a breach of these Terms and may result in loss of entries, Prize Account balances and prizes, and closure of your accounts. You must provide accurate, current information and keep it up to date; prize verification and payment depend on it. You consent to our use of geolocation, IP-address, device-signal and identity-verification measures to confirm eligibility; use of any VPN, proxy, emulator or location-spoofing tool is prohibited. You are responsible for keeping your credentials confidential and for all activity on your account. Employees, officers and directors of Super Games, its affiliates, and its agencies and contractors engaged in administering the prize promotions, and members of their immediate households, are not eligible to win prizes.

4. Your license to use the Game

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and play the Game on a compatible device you own or control, for personal, non-commercial entertainment, subject to your compliance with these Terms. Except as expressly permitted by law, you must not copy, modify, distribute, sell, rent, lease, reverse engineer, decompile or create derivative works of the Game, or use it for any commercial purpose. All intellectual property rights in the Game, including the Molly's Match name, logo, artwork, characters, game design, software and content, belong to Super Games or its licensors. Nothing in these Terms transfers ownership of those rights to you.

5. In-app purchases, Tickets and Virtual Items

In short: Purchases are optional digital content with no money value, and cannot be cashed out. Purchases don't buy entries or wins. Sales are final except where the law or the app store says otherwise.

The Game is free to download and play, and every prize mechanic is free to enter. You may choose to make optional in-app purchases of virtual items such as boosters, extra moves, passes, upgrades and bundles that may include Tickets (collectively, “Virtual Items”). “Tickets” are virtual progression points that advance your position on the in-Game Progress Bar as described in the Official Rules; Tickets are not entries, are not chances to win, and are not currency. Virtual Items (including Tickets) are licensed to you for use within the Game only, are not your property, have no monetary value, cannot be exchanged for cash or anything of value, and cannot be transferred, sold or traded. Virtual Items are distinct from Prize Account balances and cash prizes, which are governed by the Official Rules. Purchases are payments for digital content only, are not payments for entries or chances to win, and are not required to enter or win; every entry has an equal chance of winning, and the odds of each Weekly Random Number Match prize are fixed per entrant per week regardless of purchases or the number of entries you hold. Purchases are processed by the app store or our payment providers; prices are shown before you buy, and we may change the price, range or availability of Virtual Items at any time without affecting completed purchases. All purchases are final and non-refundable, except as required by applicable law or the refund policy of the relevant app store. If your account is closed for fraud or serious breach, unused Virtual Items may be forfeited without refund except where a refund is required by law.

6. Prize mechanics and your Prize Account

In short: The Official Rules govern all prizes. Your Redemption Threshold is shown in-Game and is always between US$0.25 and US$100. Payouts go through our payment processors after verification.

The Game includes promotional prize mechanics: Instant Win prizes ($1–$10 credited to your Prize Account), a Weekly Guaranteed Prize Drawing (one $1,000 prize and one $100 prize for each weekly Entry Period commencing on or after August 24, 2026), and Weekly Random Number Match Prize Drawings for prizes of $10,000, $100,000 and $1,000,000, which are not guaranteed to be won. All prize mechanics, including eligibility, entry, odds, winner selection, verification, notification, taxes, forfeiture and payment, are governed by the Official Rules. Please read them: among other things, they explain that the $10,000, $100,000 and $1,000,000 prizes are drawn by independent random number match, that no winner is guaranteed in those drawings in any week or over the promotion period, and that each of those prize amounts is available to be won once only.

Instant Win prizes accrue to a Prize Account ledger balance, redeemable once your balance reaches your then-current Redemption Threshold. Your Redemption Threshold is set by us, may differ between players and change over time (upward or downward), will always be between US$0.25 and US$100, and is displayed in your Prize Account in-Game; increases apply prospectively only and never to a balance that has already become redeemable. Redemptions and prize payments are made through our designated third-party payment processors following verification, as described in the Official Rules; you must provide and maintain accurate payout information. Prize Account balances and pending entries are personal to you, cannot be sold, transferred, assigned or exchanged, are not deposits, do not earn interest, and are not banking, stored-value or e-money products. Dormant account balances are handled as set out in the Official Rules and applicable unclaimed property laws.

7. Responsible play, spend limits and self-exclusion

Molly's Match is designed to be enjoyable. Play within your means and take regular breaks. You may set spend limits at any time in Settings; once a limit is reached, no further purchases can be made within the applicable period. You may self-exclude at any time by emailing safeplay@mollysmatch.com, for six months, one year, or permanently; self-exclusion cannot be reversed within the chosen period, your account will be closed, and reactivation after a temporary exclusion requires your express request and a 24-hour cooling-off period. Acting reasonably in the interests of your welfare, we may contact you, impose spend or session limits, or suspend or close your account; verified prizes you are already entitled to will still be paid. 8. Fair play: what you must not do

You must not: use bots, scripts, automation, emulation or other technical means to play levels, submit entries or interact with the Game; create or use more than one account or multiple identities; cheat, exploit bugs, or manipulate, forge or duplicate entries, results or balances; misrepresent your identity, age, residence or location, including via VPN or location spoofing; interfere with, disrupt or attempt to gain unauthorized access to the Game, its servers or networks; harass, abuse, threaten or defraud other players or our staff, or use the Game for any unlawful purpose; sell, buy, transfer or trade accounts, Virtual Items, entries or Prize Account balances; or scrape, harvest or collect data from the Game, or use the Game or its content to train machine learning or AI systems, without our written permission. If we reasonably believe you have breached this section or compromised the fairness or integrity of the Game or its prize mechanics, we may invalidate entries, remove Virtual Items, withhold or recover Prize Account balances or prizes attributable to the breach, and suspend or close your account, in accordance with these Terms and the Official Rules.

9. Usernames, chat and content you create

The Game may allow you to choose a display name, join teams and communicate with other players (“User Content”). You are responsible for your User Content. It must not be unlawful, defamatory, obscene, hateful, harassing, misleading or an invasion of privacy, must not infringe anyone's rights, and must not include personal or contact details of any person, advertising, spam, or links to external schemes. You retain ownership of your User Content and grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display and distribute it for the purposes of operating, promoting and improving the Game. We may (but are not obliged to) monitor, moderate, remove or refuse any User Content and may restrict social features at our discretion.

10. Availability, updates and changes to the Game

We do not guarantee that the Game will be available, uninterrupted or error-free. We may suspend, withdraw or restrict all or part of the Game for business or operational reasons, and may update the Game and change its content and features at any time, including levels, difficulty, Ticket awards, Progress Bar milestones, Virtual Items, events and social features. We may require you to install updates to continue playing. Internet access is required and your network provider's charges apply. Changes will not affect entries already accrued into a pending drawing.

11. Suspending or ending your access, and how you can leave

You may stop using the Game at any time and may request account deletion by emailing support@super.gs. Deleting the app from your device does not by itself close your account. We may suspend or close your account and end these Terms if you breach these Terms or the Official Rules, if we reasonably believe your account has been used fraudulently or unlawfully, if required by law or an app store, or if we discontinue the Game. If we close your account other than for fraud or serious breach, we will pay any prize you have already been verified as entitled to, and any Prize Account balance that has become redeemable, in accordance with the Official Rules; other balances are handled per the Official Rules and applicable unclaimed property laws. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution and governing law) survive.

12. App store terms

If you downloaded the Game from the Apple App Store or Google Play, these Terms are between you and Super Games only, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Game, its content, maintenance, support, or the prize promotions, and are not sponsors of the promotions. You must comply with the applicable app store's terms. In the event of any failure of the Game to conform to an applicable warranty, you may notify the app store, which may refund the purchase price of the Game (if any); to the maximum extent permitted by law, the app store has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the Game and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.

13. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE GAME WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (B) ONE HUNDRED U.S. DOLLARS (US$100); PROVIDED THAT THIS CAP DOES NOT APPLY TO OUR OBLIGATION TO PAY A PRIZE YOU HAVE BEEN VERIFIED AS ENTITLED TO UNDER THE OFFICIAL RULES, WHOSE EXCLUSIVE TERMS GOVERN. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW, AND SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.

14. Your indemnity to us

To the extent permitted by law, you will indemnify, defend and hold harmless Super Games and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms or the Official Rules, your User Content, your misuse of the Game, or your violation of any law or third-party right.

15. Changes to these Terms

We may amend these Terms from time to time, including to reflect changes in law, changes to the Game or our business, or to correct errors. The current version will always be available at mollysmatch.com/terms. If we make material changes, we will notify you in-Game or by email a reasonable time before they take effect; continued use after a change takes effect constitutes acceptance. If you do not agree, stop using the Game and close your account under Section 11. No amendment will deprive you of a prize for which you have already been confirmed as a winner or remove entries already accrued into a pending drawing.

16. Governing law; binding arbitration; class action waiver; opt-out

These Terms and any dispute or claim (including non-contractual disputes) arising out of or relating to them, the Game or the prize promotions are governed by the internal laws of the State of Delaware, without regard to conflict-of-law rules. YOU AND SUPER GAMES AGREE THAT ALL DISPUTES WILL BE RESOLVED SOLELY BY INDIVIDUAL, BINDING ARBITRATION BEFORE A SOLE ARBITRATOR UNDER THE STREAMLINED ARBITRATION RULES & PROCEDURES OF JAMS, INC., AND EACH WAIVES THE RIGHT TO A TRIAL BY JURY AND TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, REPRESENTATIVE OR PRIVATE-ATTORNEY-GENERAL ACTION. Any required in-person hearing will take place in the State of Delaware, provided either party may appear by telephone or video. We will pay the JAMS administrative fees and the arbitrator's fees (excluding your travel or other personal costs). Either party may bring qualifying claims in small claims court, and we may seek injunctive or equitable relief in the state and federal courts of Delaware or any court with jurisdiction. If the class action waiver is held unenforceable as to a particular claim, that claim must be brought exclusively in a court of competent jurisdiction in the State of Delaware. Judgment on any arbitration award may be entered in any court with jurisdiction. OPT-OUT: You may opt out of this arbitration agreement by mailing written notice to Molly's Match — Arbitration Opt-Out, Super Games, Inc., 131 Continental Dr, Suite 305, Newark, DE 19713 U.S.A., within thirty (30) days of first accepting these Terms, stating your name, address, account email and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms, including the class action waiver. To the extent permitted by law, any claim arising out of or relating to these Terms or the Game must be commenced within one (1) year after it accrues, or it is permanently barred. Disputes relating to prize mechanics are also subject to the dispute-resolution provisions of the Official Rules, which control in the event of any inconsistency.

17. Other important terms

We may assign or transfer our rights and obligations under these Terms to an affiliate or a successor in interest. You may not transfer your rights or obligations, your account, or any Prize Account balance to anyone else. These Terms are between you and us; no other person has rights to enforce them, except Apple as described in Section 12. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder remains in effect. Our delay in enforcing these Terms is not a waiver. These Terms, together with the Official Rules and the Privacy Policy, are the entire agreement between you and us regarding the Game.
